The County of Northampton Controller's Office received a rating of "pass" in its External Quality Control Review in accordance with the guidelines of the Association of Local Government Auditors for the period January 1, 2022, though December 31, 2024.
"Based on the results of our review, it is our opinion that the County of Northampton Controller's Office internal quality control system was adequately designed and operating effectively to provide reasonable assurance of compliance with Government Auditing Standards and applicable legal and regulatory requirements for engagements during the period January 1, 2022, through December 31, 2024."

The regular meeting of the Northampton County Council was held on the above date with the following present: Kenneth M. Kraft, President; Jeff Warren, Vice President; Jason B. Boulette; Theresa Fadem; Thomas A. Giovanni; David Holland; Kelly Keegan; Nadeem Qayyum; Lori Vargo Heffner; Alene M. Shafnisky, Clerk to Council; Jenesia Negron, Deputy Clerk to Council, and Matthew J. Deschler, Solicitor to Council.

Approval of the Minutes – July 16, 2026
Ms. Keegan made the following motion:
Be It Moved By the Northampton County Council that the minutes of the July 16, 2026 meeting shall be approved.

Ms. Becky Bartlett, Nazareth, PA – read and submitted a letter (Attachment #1) and stated there was a public notice by Hercules Cement Company, also doing business as Buzzi Unicem, requesting a lowering of their controls on nitrogen oxides and other organic compounds in exception to Section 184 of the Clean Air Act. She further stated that these particulates were known to cause health issues.
Ms. Bartlett advised that the Lehigh Valley had a scientifically proven problem with particulate pollution, with some of the highest asthma rates in the nation. She requested that County Council and the Administration file a formal objection to the request of Buzzi Unicem with the PA Department of Environmental Protection (DEP).
Mr. Joe Walsh, East Allen Township, PA - thanked County Council for working to preserve our Constitution by opposing the continued killing of both US Citizens and others by ICE.
Ms. Jaqueline Moore, Easton, PA – stated several examples that she believed demonstrated her being targeted by Easton Vice Mayor Frank Pintabone and that the police did not help her.
County Executive Report
Ms. Tara Zrinski, County Executive, advised she would look into these situations, and her office would offer opposition to the Buzzi Unicem request with the PA DEP.
Ms. Zrinski stated that the Department of Community and Economic Development had opened the Public Safety grant program, and explained where additional information could be found. She further stated the Grow Norco grant applications were being reviewed and that Hotel Room Rental Tax applicants would be reviewed shortly. She stated they continued to manage affordable housing initiatives, planned Countywide events and administered pass through grant programs.
Ms. Zrinski advised that the Elections Office was actively interviewing applicants for the Deputy Registrar, as well as evaluating processes to improve operations. She acknowledged the Elections Commission had to cancel a meeting due to an administrative oversight.
Ms. Zrinski stated that they continued to work diligently on the Gracedale Strategic Plan, as well as a plan to improve safety at the Prison. She further stated that staff attended National Night Out with local law enforcement, and that they were working with agencies to train in suicide awareness to avoid future tragedies.
Ms. Zrinski advised that in response to a recent complaint, the Department of Health had visited Gracedale and found the complaint to be unsubstantiated. She stated that there was no way to change the licensing status until more time went by, but that care for the residents continued to be recognized for their compassion even while they were struggling. She presented a certificate to Shannon Aleman, who had earned the designation of a Quality Assurance and Performance Improvement Certified Professional from the American Association of Post-Acute Care Nursing, a designation recognized by the Center for Medicaid and Medicare Services.
Ms. Zrinski stated that along with attending local national night out festivities, the Sheriff's Department welcomed people interested in law enforcement to apply for their Department and were pleased to welcome Deputy José Melendez, a military veteran, to the Sheriff's Department. She further stated that a walk-through was conducted to evaluate continued construction at the Prison, and that Public Works had been receiving proposals to replace historic Bridge 149. She stated the Department was also working on the elevators at Gracedale using grant funding, and had intended to have an alternative contract on tonight's agenda for the parking garage replacement.
Ms. Zrinski advised that although a contract had been approved with Mohawk, it was later determined that although they had assured that they could meet the Responsible Contractors Ordinance (RCO) standards, they could not provide those required certifications. She further advised that meant the contract had to be awarded to the second highest bidder which was Wilmer R. Schultz, Inc., who had already provided documentation proving they met the RCO requirements.
Ms. Zrinski stated they had onboarded 23 new employees, approximately half of whom were at Gracedale. She further stated that the Warden had retired from the Northampton County Prison after 34 years of service to the County. She thanked him for his extraordinary service and wished him a happy retirement. She stated the Department of Corrections had placed 10 inmates directly into inpatient facilities saving the County $33,169.50. She further stated this was important due to the current deficit situation in the budget.
Ms. Zrinski advised that Fiscal Affairs continued to work on the 2027 budget, and in the Criminal Division they continued to provide excellent service despite ongoing staffing shortages. She further advised the transition to a fully paperless criminal case system remained a priority and they were now scanning all criminal case documents, improving electronic access for the Courts and other offices for the public. She advised Archives continued to field increased historical record requests related to America 250.
In response to a question from Mr. Kraft, Ms. Zrinski stated that they were pursuing available grants for anything they could find at the Prison including historical preservation money.
Consideration of a Resolution Approving the Annual Action Plan for Fiscal Year 2026 for the County of Northampton
Mr. Warren introduced the following resolution:
R.78-2026. A resolution approving the aNNual action plan for fiscal year 2026 for the county of Northampton
WHEREAS, under Title I of the Housing and Community Development Act of 1974, as amended, the Secretary of the U.S. Department of Housing and Urban Development (HUD) is authorized to extend financial assistance to communities in the prevention or elimination of slums or urban blight, or activities which will benefit low- and moderate-income persons, or other urgent community development needs; and
WHEREAS, under the HOME program created by the National Affordable Housing Act of 1990, as amended, the Secretary of HUD is authorized to extend financial assistance to participating jurisdictions to expand the supply of decent, safe, sanitary, and affordable housing; and
WHEREAS, under the ESG program created by the McKinney Homeless Assistance Act of 1987, Title IV, Subtitle B, as amended, the Secretary of HUD is authorized to extend financial assistance to participating jurisdictions to Engage homeless individuals and families living on the street; Improve the number and quality of emergency shelters for homeless individuals and families; Help operate these shelters; Provide essential services to shelter residents; Rapidly re-house homeless individuals and families; and Prevent families and individuals from becoming homeless; and
WHEREAS, the County under its Citizen Participation plan engaged the community, collaborated with other public and private partners that assisted in the development and review of the Annual Action Plan, towards the County’s efforts in directing HUD funding programs for the FY 2026 program year; and
WHEREAS, the U.S. Department of Housing and Urban Development has advised the County of Northampton that under Fiscal Year 2026, the County is eligible to apply for an entitlement grant under the Community Development Block Grant (CDBG) Program in the amount of $2,228,708, the HOME Investment Partnership Program (HOME) in the amount of $660,306.06, and the Emergency Solutions Grants Program (ESG) in the amount of $197,804; and
WHEREAS, the County of Northampton’s Department of Community and Economic Development has prepared a FY 2026 Annual Action Plan which proposes how the entitlement grant funds will be expended to address the housing and community development needs identified in the County’s Five-Year Consolidated Plan; and
Now, therefore, be it resolved by the Council of the County of Northampton:
1. That the FY 2026 Annual Action Plan, is hereby approved; and
2. That the County is fully informed of any conditions that are required in the undertaking and carrying out of housing and community development activities with Federal financial assistance; and
3. That the County Executive is authorized to execute and file the financial assistance application forms with the U.S. Department of Housing and Urban Development (HUD) which has indicated its willingness to make these funds available to carry out the CDBG Program in the amount of two million two hundred twenty eight thousand seven hundred and eight dollars ($2,228,708), HOME Program funding in the amount of six hundred sixty thousand three hundred six dollars and six cents ($660,306.06), ESG Program funding in the amount of one hundred ninety-seven thousand eight hundred and four dollars ($197,804), and is further authorized to act as the authorized representative of the County of Northampton to sign any and all documents in regard to these programs; and
4. That the County Executive is hereby authorized to provide assurances and/or certifications as required by HUD and also provide any additional documents that may be requested.
As there were no comments or questions, Mr. Kraft called for the vote on the resolution.
The vote: Warren, “yes”; Giovanni, “yes”; Holland, “yes”; Keegan, “yes”; Kraft, “yes”; Qayyum, “yes”; Vargo Heffner, “yes”; Boulette, “yes” and Fadem, “yes.”
The resolution was adopted by a vote of 9-0.
Consideration of a Resolution Approving the Formal Request of a Main Street Matters Program Grant on Behalf of ArtsQuest
Mr. Warren introduced the following resolution:
R.79-2026. A resolution approving tHE formal request OF a main street matters program grant on behalf of ARTSQUEST
WHEREAS, The Main Street Matters program (MSM), through the Department of Community and Economic Development of the Commonwealth of Pennsylvania, is designed to support downtown cores and surrounding neighborhoods with tools to create healthy, vibrant, and welcoming communities; and funding is available to support revitalization efforts in planning, business support, aesthetic improvements, and the increase of safety and security; and
WHEREAS, the Northampton County Department of Community and Economic Development (DCED) and ArtsQuest have prepared all the documentation necessary to submit a request for this funding.
NOW, THEREFORE, BE IT RESOLVED the County of Northampton hereby approves submitting a request as the eligible applicant on behalf of ArtsQuest, for a Main Street Matters Program grant in the amount of $350,000 to transform the plaza spaces adjacent to the 150-year-old Bethlehem Steel Turn & Grind Shop and the Bethlehem Visitor’s Center into a multi-purpose hub for public exhibitions and festivals, including ArtsQuest’s annual Musikfest festival and Christkindlmarkt holiday market, that will attract visitors from across the nation and around the world, boosting the local economy for hotels, restaurants, and small businesses across the Lehigh Valley.
be it further RESOLVED that the Council of Northampton County does hereby designate the County Executive to execute all documents and agreements to facilitate and assist in obtaining the requested grant and that the Director of Northampton County Department of Community and Economic Development is designated as the second signatory on all documents and agreements.
As there were no further comments or questions, Mr. Kraft called for the vote on the amended resolution.

Consideration of a Pilot Program for Farmers’ Market Access Resolution
Mr. Boulette introduced the following resolution:
R.80-2026. WHEREAS, farmers’ markets are vital resources for the community that increase access to fresh food, strengthen social connections, and support the local farmers that are a bedrock of the Northampton County economy; and
WHEREAS, producer-only farmers’ markets are those where vendors sell items they have grown or made themselves, thus providing fresher goods harvested more recently and that have traveled a shorter distance; and
WHEREAS, Northampton County has seven (7) producer-only farmers’ markets in the form of the Bethlehem Farmers’ Market, the Easton Farmers’ Market, the West Ward Market, the Farm Market at Northampton Community College, the Nazareth Farmers’ Market, the Northampton Borough Farmers’ Market, and the Saucon Valley Farmers’ Market; and
WHEREAS, 2025 data indicates that farmers’ markets have a dedicated customer base across Pennsylvania, with 38% of shoppers visiting weekly, and with shoppers spending an average of $31.24 per visit; and
WHEREAS, surveys conducted by Buy Fresh Buy Local-Greater Lehigh Valley (BFBL-GLV) show that in the Lehigh Valley, the share of customers spending $30 or more per visit rose from 19% in 2019 to 28.1% in 2023; and
WHEREAS, the Commonwealth of Pennsylvania provides funding for the Senior Farmers’ Market Nutrition Program (FMNP), administered by each county’s Area Agency on Aging, to give vouchers to seniors which can be redeemed for food from participating farmers; and
WHEREAS, in 2023 Senior FMNP benefits were doubled from $25 across five $5 vouchers to $50 across five $10 vouchers; and
WHEREAS, this increase in benefits increased the number of vouchers redeemed in the Lehigh Valley, from $31,000 redeemed in 2022, to $83,000 redeemed in 2023, and $122,000 redeemed in 2024; and
WHEREAS, in 2025 BFBL-GLV and Two Rivers Health and Wellness Foundation ran a pilot program which provided $10 for every $5 Senior FMNP voucher, tripling the value of Senior FMNP benefits; and
WHEREAS, despite the increase in redemption spurred by benefit increases, over the past decade around $1.3 million in Senior FMNP funds have gone unredeemed; and
WHEREAS, these unused vouchers represent not only a failure to deliver nutritional support for our seniors but also decreased revenue for our county farmers; and
WHEREAS, lack of transportation options to participating farmers’ markets is a key reason why vouchers may go unredeemed; and
WHEREAS, the Lehigh and Northampton Transit Authority (LANTA) operates LANtaVan, a door-to-door shared ride (paratransit) service available to eligible riders, including clients of the Northampton County Area Agency on Aging; and
WHEREAS, the average weekday paratransit ridership exceeded 1,000 trips per day prior to the COVID-19 pandemic but is now at only around 800 passenger trips a day.
NOW THEREFORE, BE IT RESOLVED, that the Northampton County Council encourages the Northampton County Area Agency on Aging to pursue a pilot program with LANTA to utilize paratransit vans to shuttle individuals from Northampton County Senior Centers to producer-only farmers’ markets and back.
BE IT FURTHER RESOLVED, that Senior FMNP vouchers should be made available to seniors participating in the pilot shuttle program.

Mr. Warren made a motion to amend the agenda to add a resolution regarding the Administrative Code Article XIII contract with Wilmer R. Schultz, Inc., for the replacement of the parking deck. He added that the contract itself had previously been approved by Council, and in appreciation for the need to replace the parking deck as soon as possible, he wanted to consider the contract approval without delay.
Ms. Fadem seconded the motion.
Mr. Kraft called for the vote on the motion.
The vote: Warren, “yes”; Fadem, “yes”; Kraft, “yes”; Qayyum, “no”; Vargo Heffner, “yes”; Boulette, “yes”; Giovanni, “yes”; Holland, “yes” and Keegan, “yes.”
The motion to amend the agenda to introduce the resolution passed by a vote of 8-1.
Consideration of Administrative Code Article XIII Contract Resolution: Wilmer R. Schultz, Inc.
Mr. Boulette introduced the following resolution:
R.81-2026. WHEREAS, Northampton County Administrative Code Article XIII Procurement and Disposition of County Property, Section 13.15 Contracts and Agreements c.(1) requires approval of County Council for "...any contract exceeding $100,000, which was awarded using the Competitive Negotiation, Negotiation After Competitive Sealed Bidding and Non‑Competitive Negotiation source selection methods. For contracts with renewal clauses, the entire potential payout if all renewal clauses are exercised under the terms of the contract must be considered when determining if Council approval is necessary;” and
WHEREAS, on July 31, 2026, the Northampton County Council received a request from the County Executive for County Council to adopt a resolution endorsing a contract with Wilmer R. Schultz, Inc., to serve as the Government Center Parking Deck Replacement Project – General Contractor Prime Contract, for a term of two (2) years, at a total cost of $11,605,000.
NOW, THEREFORE IT IS HEREBY RESOLVED that the Northampton County Council does hereby concur with the recommendation of the County Executive, as set forth in the attached documentation, to approve the contract with Wilmer R. Schultz, Inc.
IT IS FURTHER RESOLVED, with the adoption of this Resolution, Resolution No. 51-2026, is hereby rescinded.
Mr. Kraft indicated that they had previously reviewed the specifications of the contract and prior bids.
As there were no further comments or questions, Mr. Kraft called for the vote on the resolution.

Solicitor Deschler stated that the agenda as amended should be posted online and at the Clerk's office within one business day.
Council Committee Reports
Mr. Warren advised that the Economic Development Committee had met and discussed the 2026 CDBG grants and also had a presentation from ArtsQuest.
Mr. Warren stated the Human Services Committee received an update from the Department of Veterans Affairs as well as the Division of Children, Youth and Families.
Mr. Kraft advised that a pre-bid meeting was held for the updates on the audio/visual to the Council meeting room, and that bids were due back on August 19th with plans to discuss the bids at the September Finance Committee meeting.
Council Liaison Report
Mr. Boulette stated that the Industrial Development Authority met and had reported a clean fiscal year audit, elected new officers, and stated that they had been informed that the Dixie redevelopment project was going to proceed utilizing a TIF from just the Borough of Wilson and Wilson Area School District. He further stated they had to get a new site study done to ensure that the new tax numbers met all of the tax credit requirements.
Mr. Qayyum advised he attended the Northampton County Housing Authority meeting, and reported that all County public housing sites were at over 95% occupancy, with 540 vouchers awarded. He further advised that the occupancy rate across all public housing was 90.74%.
Mr. Qayyum stated the Airport Authority had moved their meeting to the following month.
Mr. Qayyum advised that he felt they owed it to the public and future Councils to carefully examine what they were trying to do with the Employee Policy Manual (EPM). He gave a background of the issue between prior Councils and prior Executives, including the litigation in 2008, and advised that in spite of the history, Executives were still using the exception clause in the Career Services Regulations (CSR), without approval from Council. He advised that in 2015, Council led by Mr. Lamont McClure refused to concede the power of determining salary, and determined that County Executive John Brown’s attempt to unilaterally grant raises in 2015 was a clear violation of the Home Rule Charter and the Administrative Code.
Mr. Qayyum stated that Council was now proposing a codified Executive authority to grant step increases for employees up to Step 3 that he could not support. He further stated that this practice was using an exception clause that was never codified or approved by County Council, and the EPM had never come to Council or the Personnel Commission. He stated that Council clearly had the power to set salaries, and if the Executive wanted to grant step increases to exempt employees, they could justify that to Council. He further stated that was not restricting authority, but instead was enforcing the Charter. He went on to say that the 2015 Council was not fighting over Career Service classifications, but were instead defending the principle that the Executive could not unilaterally approve raises without Council oversight.
Mr. Kraft advised that the situation was different than 2015, where the Executive was giving out raises to people without approval. He further advised what happened this year was the County Executive asked to appoint a qualified person to a Cabinet position, and asked for County Council to approve the step level that she thought was appropriate for that individual.
Mr. Warren stated that he attended the annual conference of the County Commissioners Association of Pennsylvania (CCAP), and that he sat on the Technology Committee. He further stated that there was a discussion with a lot of sobering ideas with regard to artificial intelligence (AI) and its effects on counties in the future. He stated that in Berks County, they had 300,000 AI based right to know requests, and Northampton had to be prepared to deal with a similar situation.
Ms. Vargo Heffner advised that at CCAP, she attended the Human Services and Courts and Corrections Committee meetings, and stated they had started a Health Task Force Advisory Group to review the State health crisis that developed through increasing health deserts with no services. She further advised that legislation considering body cameras for probation officers was now in the PA Senate, and this was merely the right to have body cameras, rather than a mandatory requirement.
Mr. Boulette stated that he had attended the CCAP Governance Committee meeting, where they discussed a new law that would require Chief Assessment Officers for each county to maintain contact information for property owners any time a property was sold or anytime a municipality in the county issued a code violation. In response to a question from Mr. Kraft, Mr. Boulette stated this would allow for the tracking of landlords who had a history of violations.
Mr. Boulette advised that the CCAP Economic Development Committee meeting informed attendees that the tax credit program known as the Neighborhood Partnership Program, which the state used to support community revitalization efforts through grants, was being discontinued. He further advised that if there were areas with multicultural plans being benefited under this program, they should put something out to the State Department of Economic Development to encourage them to continue this program. He stated Slate Belt Rising currently benefited from this program.
In response to questions from Mr. Qayyum, Mr. Kraft stated that as President of Council he had the opportunity to select 5 voting attendees to the CCAP meeting. He further stated that he felt the County Executive should have a vote, but he felt that CCAP existed primarily as a lobbying body. Mr. Qayyum stated that a Council Member who was running for a CCAP position did not receive a vote, and Mr. Kraft said he was not aware of anyone running for a CCAP office, and the selection of who voted was a prerogative of the President.
Mr. Giovanni advised that he had also attended CCAP, and attended a meeting where reassessment was discussed. He further advised that assessment requirements could be coming in the near future, and stated that counties needed to consider how to deal with data centers and how they affected our environment and our electric bills.
